On 2 April 2026, the TWU and ARTIO made a joint application to the Fair Work Commission for an urgent fuel cost recovery order.

The commission issued a notice of intent and draft order on 14 April, after Employment and Workplace Relations Minister Amanda Rishworth determined that the application for an order from the TWU and ARTIO met the requirements for an emergency application.

The ATA made a series of submissions to the commission aimed at ensuring that any order resulting from the process is effective and workable.
